Court’s ruling 

In this case, the Court ruled that the French rules on criminal liability for online hate speech only applies when the electronic public communication service is provided from France. It is therefore up to the judge to determine whether the person accused of a press offence, resulting from comments linked to the French territory posted online on a website published abroad, has personally participated in the dissemination in France of the disputed comments.
