Facts

The applicant, the Villerupt driving school, wished to obtain driving licence documents held by the sub-prefecture services. The sub-prefecture refused to disclose these documents. The applicant filed a complaint to the administrative court who rejected it. 

Complaint

The applicant complained that the sub-prefecture refused to disclose these documents and sought annulment of the decision.

Court’s ruling

The Council of State observed that the driving school had complained to the administrative court without first seeking the Commission for access to the administrative documents. Its appeal was therefore clearly inadmissible, even if the sub-prefecture had requested the Commission’s opinion, because the applicant had the obligation to request first the Commission before complaining to the administrative court.
